NOTICE OF SALE

Under and by virtue of an Order of the District Court of Brunswick County, North Carolina, made and entered in the action entitled “County of Brunswick vs. Beach Flowers, Inc., et al,” the undersigned commissioner will on the 1st day of February, 2019, offer for sale and sell for cash, to the last and highest bidder at public auction, at the courthouse door in Brunswick County, North Carolina, in Bolivia at 12:00 noon the following described real property, lying and being in the State and County aforesaid, and more particularly described as follows:

PARCEL # 217LB065:

BEING all of LOT 65, Station VI, River Run Plantation (formerly Pier 66 Subdivision); the subdivision plat for Lots 1-175, Station I appears of record in Map Cabinet K, Page 256; for Lots 176-213, Station I appears of record in Map Cabinet Q, Page 367; for Stations II and III appears of record in Map Cabinet L, Page 177; and for Station IV appears of record in Map Cabinet R, Page 272; for Station V appears of record in Map Cabinet R, Page 273; for Station VI appears of record in Map Cabinet R, Page 274; and for Station VII appears of record in Map Cabinet S, Page 315 of the Brunswick County Registry.

There is EXCEPTED from this conveyance the mineral rights which have been retained by Weyerhauser Real Estate Company as appears in Book 424, Page 79, of the Brunswick County Registry.

This conveyance is made SUBJECT to the Consolidated Master Declaration and Development Plan which appears in Deed Book 728, Page 702 of the Brunswick County Registry; said Consolidated Master development Plan, Covenants and Restrictions as identified, are included herein to the same effect and with the same legal force as if they were repeated fully in this instrument, said covenants and restrictions shall be deemed appurtenant to the lots(s) and shall run with the lot (s) in all future conveyances.

The sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above-described property not included in the judgment in the above-entitled cause.  A deposit of 5 percent of the successful bid will be required.
