NOTICE OF RESALE

Under and by virtue of an Order of the District Court of Brunswick County, North Carolina, made and entered in the action entitled “County of Brunswick vs. Chappel Loop Properties, LLC,” the undersigned commissioner will on the 9th day of February, 2018, offer for resale and sell for cash, to the last and highest bidder at public auction, at the courthouse door in Brunswick County, North Carolina, in Bolivia at 12:00 noon the following described real property, lying and being in the State and County aforesaid, and more particularly described as follows:

PARCEL # 04800022:

BEGINNING at an iron pipe in the Southern line of SR # 1524 (60 foot right of way) that is North 82 degrees 13 minutes East along said line of said road 60.30 feet from an existing iron pipe, the Northeastern corner of the 3.198 acre tract conveyed to Lewis C. Howlett and wife by Deed recorded in Book 762 at Page 482 of the Brunswick County Registry, said Howlett corner being North 82 degrees 32.5 minutes East along said line of said road 1646.18 feet from an existing iron pipe at the beginning of a curve that is South 63 degrees 55 minutes East a chord distance of 335.50 feet from an existing iron pipe at the end of said curve and at the intersection of said line of said road with the Western line of John D. Smith Road (60 feet right of way), said intersection point being a corner of the tract conveyed to Hayes Concrete Company, Inc., by Deed recorded in Book 448 at Page 131 of said registry, said last-mentioned point being South 30 degrees 23.5 minutes East along the Southwestern line of SR 1524 84.25 feet from its intersection with the Southeastern line of Ploof Road (80 foot right of way), the Northern most corner of said Hayes Concrete Company, Inc. tract; running thence from said Beginning point North 80 degrees 55.5 minutes East along the Southern line of SR # 1524 160.00 feet to a iron pipe that is South 79 degrees 28 minutes West along said line of said road 65.07 feet from an existing iron pipe at its intersection with the old Glastonbury line, the Northern line of the R L Burnett tract; thence South 3 degrees 57 minutes East 780.69 feet to an iron pipe; thence North 87 degrees 42 minutes West 185.01 feet to an iron pipe that is North 87 degrees 56 minutes East 60.00 feet from an existing iron pipe, the Southeastern corner of said Howlett tract; thence North 2 degrees 04 minutes West and parallel with the Eastern line of said Howlett tract 746.65 feet to the point of Beginning; the same containing 3.00 acres and being a portion of the tract conveyed to Lincoln Development Company, Inc. by Deed recorded in Book 296 at Page 628 of the Brunswick County Registry.

Together with an easement sixty feet in width for ingress and egress, the Eastern line of the same being the Western line of the above described tract, said easement extending the entire length of said line.

Being the same tract as the 3.00 acre tract shown on the map prepared by Howard M. Loughlin, R.L.S. dated February 9, 1989.

The sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above-described property not included in the judgment in the above-entitled cause.  A deposit of 5 percent of the successful bid will be required.
