NOTICE OF SALE
Under and by virtue of an Order of the District Court of Brunswick County, North Carolina, made and entered in the action entitled “County of Brunswick vs. Beaver Creek Associates, LLC and The Town of Oak Island,” the undersigned commissioner will on the 15th day of December, 2017, offer for sale and sell for cash, to the last and highest bidder at public auction, at the courthouse door in Brunswick County, North Carolina, in Bolivia at 12:00 noon the following described real property, lying and being in the State and County aforesaid, and more particularly described as follows:
PARCEL # 2360001601:
BEING all of that tract of land in Smithville Township, Brunswick County containing 30 acres more or less and more particularly described as:
BEGINNING at a cedar at the edge of the marsh of Elizabeth Creek, Smith’s corner; runs N 100 poles to a stake at the edge of a small pond; thence E 48 poles to a stake; thence S 100 poles to a stake at the edge of the marsh; thence with the edge of said marsh to the BEGINNING, containing 30 acres, more or less, and being the same land conveyed to D.P. Xanthos by Abram Galloway and wife, Celia Galloway, by Deed dated November 21, 1925 and recorded in the Brunswick County Registry in Deed Book 38, Page 297.
The sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above-described property not included in the judgment in the above-entitled cause. A deposit of 5 percent of the successful bid will be required.
