Under and by virtue of an Order of the District Court of Brunswick County, North Carolina, made and entered in the action entitled “County of Brunswick vs. Katherine E. Railo and Douglas G. Railo” the undersigned commissioner will on the 4th day of March, 2021, offer for sale and sell for cash, to the last and highest bidder at public auction, at the courthouse door in Brunswick County, North Carolina, in Bolivia at 12:00 noon the following described real property, lying and being in the State and County aforesaid, and more particularly described as follows:

PARCEL # 202BA156:

Being all of Lot 1007, Phase 7B, as shown on that map of SeaWatch at Sunset Harbor dated 28 September 2005 entitled “SeaWatch at Sunset Harbor,” prepared by Perry G. Davis, Jr., P.L.S., Cape Fear Engineering, Inc., recorded in Map Cabinet 33 at Pages 319 through 320, inclusive, to which map reference is hereby made an which is incorporated herein for greater certainty of description of said (the “Homesite”).

The Homesite is conveyed subject to all ad valorem taxes for the current year, which are to be prorated between the parties using the calendar year as the basis, and subject to all easements, restrictions and rights of way of record, including without limitation all of those covenants, conditions, restrictions and easements running with the title to the Homesite as set forth in that Master Declaration of Protective Covenants and Easements for SeaWatch at Sunset Harbor recorded in Book 1864 at Page 714, Brunswick County Registry, as it may be amended from time to time (the “Master Declaration”), in that Supplemental Declaration for Phase 7B, recorded in Book 2254 at Page 19, Brunswick County Registry, as it may be amended from time to time (the “Supplemental Declaration”), and on the aforementioned recorded map, and reservation or mine and mineral royalty rights in favor of International Paper Company and International Paper Realty Company recorded in Book 630 at Page 20 and Book 1231 at Page 769, Brunswick County Registry.

The sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above-described property not included in the judgment in the above-entitled cause. A deposit of 5 percent of the successful bid will be required.
